Managing Disputes Strategically in a Global Commercial World

This intensive five-day programme provides a practical and internationally relevant understanding of how ADR mechanisms operate and how they should be used strategically. Participants will explore mediation, arbitration, negotiation, and hybrid processes within a structured framework that emphasises decision-making, risk management, and enforceability.

 

The programme also examines the international legal architecture supporting ADR, including the UNCITRAL Model Law and the New York Convention 1958 on the Recognition and Enforcement of Arbitral Awards.

01 Understand the role and strategic relevance of ADR in modern dispute resolution — and when to use it over litigation.

 

02 Distinguish between mediation, arbitration, negotiation, and hybrid mechanisms, and select the most appropriate process for each dispute context.

03 Draft and evaluate effective ADR and arbitration clauses that are clear, enforceable, and fit for purpose in cross-border transactions.

04 Understand the international arbitration framework, including the UNCITRAL Model Law and the New York Convention 1958.

 

05 Prepare effectively for arbitration proceedings and hearings, including evidence preparation, written submissions, and witness management.

 

06 Assess enforcement and challenge mechanisms for arbitral awards across jurisdictions, including grounds for refusal and setting-aside.

DAY 01 Foundations of ADR

              Focus: Strategic knowledge and drafting of ADR processes in contracts.

DAY 02 Mediation and Negotiation in Practice

              Focus:  Practical skills for conducting, negotiating, and formalising mediated settlements.

DAY 03 Arbitration: Legal Framework and Structure

              Focus:  International arbitration drafting and enforceability in cross-border disputes.

DAY 04 Conducting and Managing Arbitration Proceedings

              Focus:  Hands-on procedural and strategic skills for conducting arbitration effectively.

DAY 05 Awards, Enforcement, and Challenges

              Focus:  Ensuring enforceable, well-structured arbitration outcomes while managing legal and practical risks internationally.

Before you decide

Do I need to be a lawyer to attend?

No. This programme is designed for anyone who works with legal documents in English — including lawyers, in-house counsel, legal translators, paralegals, and professionals in regulated industries who need Legal English for their work .

Do I need prior English law knowledge?

No. The programme is designed to be accessible to lawyers without formal English law training. Day 1 establishes the foundations, and each subsequent day builds on that systematically.

Is this lectures or practical work?

Both — but the emphasis is practical. Every day includes case-based exercises, transaction scenarios, and problem-solving designed to mirror real advisory situations you'll face in your work.

Will I receive a certificate?

Yes. EMG Associates is authorised by the SRA and Dubai GLAD to provide CPD. Participation counts towards your applicable CPD/CLPD requirements, subject to your professional body's rules.

What if I need to cancel?

What level of English is required?

Participants should have a good general English proficiency (approximately B2 / Upper Intermediate level or above).
